Overview

Welcome to Lucid Vinyl. Throughout this document, "we", "us" and "our" mean Lucid Vinyl. We run this website and store, along with all of the content, features, tools, products and services connected to it, so that you — our customer — can shop a curated selection in one place (collectively, the "Services"). Our storefront runs on Shopify, which is the platform that makes the Services possible.

The terms and conditions set out below, along with any policies we link to here (the "Terms of Service" or "Terms"), lay out what you can expect from us and what we expect from you when you use the Services.

Take the time to read these Terms. They cover meaningful points about your legal rights, including sections on warranty disclaimers and limits on our liability.

Using, browsing, or interacting with the Services means you accept these Terms of Service and our Privacy Policy. If any part of them doesn't sit right with you, please don't use the Services.

Section 1 — Access and Accounts

By accepting these Terms, you confirm that you have reached the age of majority where you live, and that any minor in your care who uses the Services on a device you own, buy, or manage is doing so with your permission.

Using the Services — browsing the shop, or buying anything we sell — may require you to share details such as your email address and your billing, payment, and shipping information. You confirm that everything you give us is accurate, current, and complete, and that you have the right to share it.

Keeping your login details secure is your responsibility, as is everything that happens under your account. Accounts can't be sold, transferred, assigned, or licensed to anyone else.

Section 2 — Our Products

We work hard to show our products accurately online. Even so, colors and finishes can look different on your screen depending on your device and its display settings.

We make no promise that a product's look or quality will match your expectations or appear exactly as it did in our store listing.

Product descriptions can change at any time, without notice, at our discretion. We may also stop offering a product at any point, and we may cap how much any individual, region, or jurisdiction can buy.

Section 3 — Orders (All Sales Final)

Submitting an order is an offer to buy, not a completed sale. Lucid Vinyl can accept or turn down any order for any reason. A sale only becomes final once we confirm acceptance and your payment goes through.

Check your order over before you submit it. Once an order is placed, the sale is final — no refunds, no returns, no exchanges. And once processing starts, orders can't be canceled or changed.

If we decline or cancel an order, we'll try to reach you using the contact details you entered at checkout.

Everything you buy is also covered by our Refund & Order Issues Policy, which forms part of these Terms.

You confirm that anything you buy from us is for your own personal or household use, and not for resale or export.

Section 4 — Pricing and Payment

Prices, discounts, and promotions can change at any time without notice. You'll be charged the price that applied when you placed your order, as shown in your order confirmation email. Unless we say otherwise, listed prices exclude tax, shipping, handling, and any customs or import fees.

You agree to supply payment information that is current, complete, and accurate, and to keep your account details — including your email address and payment method — up to date so we can process your orders and reach you when needed.

You confirm that the payment details you provide are genuine and accurate, that you're authorized to use them, and that you'll cover every charge you incur at the prices listed, including any applicable taxes and shipping costs.

Section 5 — Shipping and Delivery

We aren't liable for shipping or delivery delays. Every delivery window we quote is an estimate, not a guarantee. Delays caused by carriers, customs, or anything else beyond our control are outside our responsibility. Once your order is handed to the carrier, ownership and risk of loss pass to you.

Section 6 — Damaged, Defective, or Wrong Items (Replacements Only)

Check your order as soon as it arrives, and get in touch right away if anything is damaged, faulty, or not what you ordered.

To request a replacement, email lucidvinyl0@gmail.com within 48 hours of delivery with your order number plus clear photos of both the item and its packaging.

Approved claims receive a replacement, issued at our discretion. We don't offer refunds or returns under any circumstances, damaged and incorrect items included — replacements only.

Section 7 — Intellectual Property

The Services — including every trademark, brand element, piece of text, image, graphic, and audio file, along with how they're designed and arranged — belong to Lucid Vinyl, our affiliates, or our licensors, and are protected under U.S. and international intellectual property law.

These Terms allow you to use the Services for your own personal, non-commercial purposes only. Without our written permission, you may not copy, distribute, alter, build derivative works from, publicly display, republish, download, store, or transmit any material from the Services.

The Lucid Vinyl name, logo, product and service names, designs, and slogans are trademarks of Lucid Vinyl or our affiliates, and may not be used without our written consent.

Section 8 — Optional Tools

The Services may give you access to third-party tools that we neither monitor nor control. These are offered "as is" and "as available", with no warranties and no endorsement from us. We take no responsibility for how you use them — that's entirely at your own risk.

Section 9 — Third-Party Links

You may find links to outside websites within the Services. We don't control those sites and aren't responsible for their content or accuracy. Following a link away from our Services is done at your own risk, and we'd encourage you to read the policies of any third-party site before transacting with it.

Section 10 — Our Relationship with Shopify

Lucid Vinyl runs on Shopify, which is what allows us to offer the Services. That said, every sale and purchase is made directly with Vinyl Vibe. By using the Services, you acknowledge that Shopify bears no responsibility for any part of a transaction between you and us, and you release Shopify and its affiliates from any claim, damage, or liability tied to your purchases and dealings with Vinyl Vibe.

Section 11 — Privacy

Any personal information gathered through the Services is handled according to our Privacy Policy. Because Shopify hosts the Services, it also collects and processes certain data about how you use them. Information you submit may be shared with Shopify and other third parties in order to deliver the Services to you. Our Privacy Policy has the full picture.

Section 12 — Feedback

If you send us ideas, suggestions, reviews, or any other content, you grant Lucid Vinyl a perpetual, worldwide, royalty-free license to use, copy, adapt, publish, and distribute it for any purpose, commercial purposes included.

You confirm that you own or otherwise hold the rights to whatever you send, that it infringes nobody else's rights, and that it contains nothing unlawful or harmful.

Section 13 — Errors, Inaccuracies, and Omissions

From time to time, content on the Services may contain a typo, an inaccuracy, or a gap — in a product description, a price, a promotion, a shipping charge, or an availability listing. We reserve the right to correct any such error and to update or cancel orders based on inaccurate information, at any time and without prior notice.

Section 14 — Prohibited Uses

You may not use the Services for any unlawful purpose; to break any law or regulation; to infringe intellectual property rights; to harass or harm anyone; to submit false or misleading information; to upload viruses or malicious code; or to spam, scrape, or tamper with security features. Breaking any of these rules may result in your access being cut off.

Section 15 — Termination

We may suspend or terminate your access to the Services immediately and without notice if you breach these Terms. Any amounts you owe as of the termination date remain payable.

Section 16 — Disclaimer of Warranties

The Services and all products are provided "as is" and "as available", without warranty of any kind, whether express or implied — including warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We don't guarantee that the Services will run without interruption, securely, or free of errors.

Section 17 — Limitation of Liability

To the maximum extent the law allows, Lucid Vinyl is not liable for indirect, incidental, punitive, special, or consequential damages of any kind — including lost profits, lost revenue, lost data, or the cost of replacements — arising from your use of the Services or of products bought through them. In any event, our total liability will not exceed what you paid for the product in question.

Section 18 — Indemnification

You agree to indemnify and hold harmless Lucid Vinyl along with our affiliates, partners, employees, and service providers against any claim or demand arising from your breach of these Terms or your violation of any law or third-party right.

Section 19 — Severability

Should any part of these Terms be found unlawful, void, or unenforceable, every remaining part stays in force to the fullest extent the law allows.

Section 20 — Waiver and Entire Agreement

If we don't enforce a right or provision of these Terms, that isn't a waiver of it. These Terms make up the entire agreement between you and Lucid Vinyl concerning your use of the Services.

Section 21 — Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our own rights and obligations at any time, without notice.

Section 22 — Governing Law

These Terms are governed by and interpreted under the laws of the State of California, United States. You agree that any dispute will be resolved in the courts located in California.

Section 23 — Changes to These Terms

We may revise or update these Terms at any time by posting the new version to our website. Continuing to use the Services after a change is posted means you accept it.
